By annual inspection and survey, the Office of the State Fire Marshal verifies that health care occupancies are in compliance with the State Fire Prevention Regulations. This also is in support of Department of Health and Social Service’s mission is to improve the quality of life for Delaware's citizens “by protecting vulnerable populations.” Health care facilities include hospitals, nursing homes, and limited care (assisted care) facilities. The inspection is also a requirement for those health care facilities that are deemed eligible to receive funds from the federal Center for Medicare and Medicaid Services.
In addition to hospitals and nursing homes, the Office of the State Fire Marshal inspects ambulatory surgical centers for compliance with the State Fire Prevention Regulations in order for the facility to receive an annual license from DHSS’s Office of Health Facilities Licensing and Certification.
The Office of the State Fire Marshal also investigates complaints about a facility's fire and life safety, responds to inquiries, and honors requests for consultations from the health care facilities. All fires in health care facilities are required to be reported to the State Fire Marshal within 24 hours of the incident by submitting a Fire Incident Report form.
